TERMS AND CONDITIONS

Please read our Terms and Conditions (“Terms”) carefully as these Terms constitute our legal contract with you. By visiting our space and booking classes, courses or workshops, event tickets or using our services with us (“Sessions”) you are confirming you have read the Terms and agree to be bound by them. Please also refer back to these Terms from time to time as they may change (and we reserve the right to do so).

In these Terms:

(a) “we”, “us”, “our” means ARC Community Space CIC (Company Number 10710494, registered at 98B St Paul Street, islington, London, N1 7DF ). We supply all “Sessions” subject to these Terms; and

(b)“you”, “your”, “yours” means you, the client.

DATA PROTECTION

The nature of our business and the provision by us of session to you means that we will collect and process certain of your personal data from time to time. We will only do so in accordance with our Privacy Notice, which you can read on our website.

Yoga and Movement:

HEALTH AND SAFETY

Some of our Sessions involve strenuous physical activity and we recommend that you seek medical advice before attending or participating in a Session (including virtual/online sessions). For your own safety and the safety of others we rely on you using our facilities and premises and participating in our Sessions (including online) in the intended manner and your acceptance of these Terms constitutes your confirmation that you will do so and that you will comply with our reasonable instructions in relation to your attendance at our premises or participation in a Session.

LIABILITY WAIVER

By participating in Sessions, you hereby agree the following:

For Our Yoga and Movement “Sessions”

  • You agree that any participation in a Session is entirely at your own risk.

  • You will obtain medical clearance from your health care practitioner prior to beginning the exercise programmes described on this site. The exercises described on this site are not suitable for everyone and are not a substitute for medical expertise. If done improperly, exercise has some risk of injury. If you feel discomfort or pain, DO NOT continue. We disclaim any liability or loss in connection with the exercises described herein. 

  • It is the client’s responsibility to ensure he/she is capable of undergoing the routine of exercises or postures provided by any programme which he/she follows or class which he/she attends. Clients accept the risk of injury and are advised to consult their doctor prior to beginning any session. This extends to any events or sessions offered by ARC Community Space CIC.

  • You understand that during the Sessions you may receive information and instruction about yoga, physical exercise or health, however instructors may not be qualified health professionals. You understand that it is your responsibility to consult your GP prior to and regarding your participation in classes and activities. You assume full responsibility for your own wellbeing, body, fitness level and medical conditions in regards to your participation in these classes and activities. You understand that all movement/activities are optional and that you are able to decline participation. 


  • You accept that it is your responsibility to inform your teacher at the start of each and every class you attend of any injury or health condition that you may have, but that your teacher or ARC Community Space CIC  is in no way responsible for any worsening of any condition you may have as a result of attending a class or activity. In consideration of being permitted to participate in the classes and activities, you agree to assume full responsibility for any risks, injuries or damage, known or unknown, which you might incur as a result of participating in the programmes offered by the instructor. You knowingly, voluntarily and expressly waive any claim you may have against the instructor for injury or damages that you may sustain as a result of participating in these classes and activities.

  • You understand that from time to time during the classes and activities, the instructor may physically adjust the students’ form and posture. If you do not want any physical adjustments, you will inform the instructor at the beginning of the class or activity you attend. You also acknowledge that if you receive adjustments, it is your responsibility to inform the instructor when an adjustment has gone as far as you desire at that time.

  • If you are pregnant you understand that you participate fully at your own risk and that of your unborn child/children. If pregnant, you will be responsible for notifying the instructor as classes may not be suitable during certain stages of pregnancy. 

  • You agree that ARC Collective CIC is in no way responsible for the safekeeping of your personal belongings, including when using any lockers, and you hereby take full and sole responsibility for your own personal property while you attend a Session.


  • We accept no liability for loss or damage to property of clients or for injury to clients on the Studio premises or outside the studio. Clients agree that neither they nor their heirs, assigns or legal representatives will sue or make any other claim of any kind against Yoga at the ARC or any of its teachers, or employees in respect of any loss or damage which they may suffer or incur at ARC Community Space CIC, or as a result of attending a class, whether caused by negligence or otherwise, save only to the extent that liability in respect of such loss or damage may not be excluded or limited by law.

  • sole responsibility for your own personal property while you attend a Session.

SESSIONS/MEMBERSHIPS AND USE OF OUR PREMISES

In booking a Session you agree to comply with any additional rules we may make known to you in relation to the Session from time to time, including how you may use our premises, facilities and your conduct whilst doing so.

All Sessions and instructors are subject to change from time to time, even after you have booked. 

Access to our premises, Sessions and any other goods and services we may supply from time to time is at our discretion and we reserve the right to refuse you access to any of the same, or to suspend or otherwise terminate your Account if we consider that you are in breach of these Terms, the Session Rules or your behaviour at our Premises is inappropriate, aggressive, rude, threatening or otherwise damaging to our customers, staff or our reputation more generally. If we do so you will not be entitled to any refunds.

MEMBERSHIP/SESSION TYPES

We offer different types of membership/sessions, which offer you different ways of paying for classes. More information on these may be found on our Website and the terms governing these may be found below.

Please note: Some membership/session types have an expiry date - please see our Website for details. All memberships/session options activate on the day of purchase. It is not advised to buy more than one membership/session at a time. Memberships/sessions are assigned to individual client accounts and cannot be shared between clients (with the exception of class packs at our discretion)

DROP IN

You can purchase individual sessions which can be redeemed on a pay-as-you-go basis. The drop-in rate for each Session is set out on the pricing page on our Website. 

INTRO OFFERS

Intro offer entitles you to a discounted rate in our classes for a session, classpack, or membership and the rate is set out on the pricing page on our Website. This offer will expire 1 month after purchase, is valid for new students only and can only be purchased once. Companion intro passes are only valid for new students. We reserve the right to change and amend membership perks at any time and will inform you of changes via email. 

CLASS PASSES

You can purchase standalone bundles of sessions at discounted rates (class passes) which can be redeemed against Sessions. Details of the Packages we offer will be set out on the pricing page on our Website. Packs will expire as set out on our Website and cannot be suspended or extended except at Our sole discretion.arccollective.co detailing the circumstances 2 weeks before the expiry of your pass. Any decision to suspend or extend a pass is at the Our discretion.

UNLIMITED MEMBERSHIP 

You can purchase an unlimited membership which allows you access to an unlimited amount of in studio and online classes per month. First payment will be taken on the day of sign up and the same date each month until cancelled. We reserve the right to change and amend membership perks at any time and will inform you of changes via email. 

If you wish to cancel your membership you must submit your request in writing to hello@sarccollective.co at least 7 days in advance of your next billing date.

Members are entitled to suspend their membership for the period of one month, a maximum of three times per year, and must request this in writing to hello@arccollective.co with 7 days notice.

COURSES

You can purchase a pass to one of our courses which allows you access to a set number of sessions on certain dates. Details of the Courses we offer and their sessions will be set out on our Website.

This pass cannot be suspended, extended or refunded except for exceptional circumstances.


If you need to suspend or extend your pass, please email hello@sarccollective.co detailing the circumstances. Any decision to suspend or extend a pass is at Our discretion.

WORKSHOPS

The rate for each Workshop is set out on our Website.

BOOKING SESSIONS

A) When you book a session you will be charged the Session price unless otherwise stated.

B) Your booking on a Session is only confirmed once you have received an email confirmation from us or the Session appears in the ‘Upcoming Bookings’ section of your Account. Please make sure you receive a booking confirmation before you attend the Session. If you do not receive a confirmation please contact us by email (hello@arccollective.co). Session prices, timings and instructors are subject to change at any time before we accept your booking.

C) Please refer to our Website for Session availability. Sessions may be booked up to 4 weeks in advance.

D) All Sessions are subject to availability, and whilst we try to ensure that suitable numbers and types of Sessions are available, we cannot guarantee that you will be able to book any particular Session.

If a Session is fully booked then you may either: (i) join an alternative Session; or (ii) join a waiting list for the fully booked Session. If you are on the waiting list for a fully booked Session and a space becomes available, everyone on the waitlist will be notified by email with a link to book a place at the session on a first come, first served basis. Before this time you can cancel your place on the waiting list at any time for a full refund. Each class will have a waitlist of up to 3 clients.

E) Booking closes 15 minutes prior to class start time.

F) Before attending your first session at ARC Collective you must have completed all sign up forms through the Website or App and accepted our Terms of Use and Liability Waiver. If you do not sign these terms you can be denied access to our sessions. By choosing to attend a Session you thereby accept all the liabilities whether signed for or not.

CHANGING OR CANCELLING YOUR BOOKINGS AND NO SHOWS

A) You may change or cancel your booking for a class, without charge, up to 8 hours before the start of the Session that you have booked (Early Cancellation). The class credit will be automatically refunded to your account. If you book onto a Session within 8 hours of its scheduled start time, you are not entitled to change or cancel. *All workshops operate with a 7 day cancellation period*

B) You are not entitled to change or cancel your booking for a Session or otherwise elect to receive a refund for the Session (including for a no show) within 8 hours of its scheduled start time. To do so means you will be charged the full session price (Late Cancellation). In this case you may be charged a nominal fine. *All workshops operate with a 7 day cancellation period*

C) All class passes have an expiry date, detailed on our Website and on our App.

LATENESS POLICY

We operate a zero lateness policy which prevents you from taking part in a Session if you are not inside the premises at the session start time (in such situations you will be deemed to be “late”). This policy is in place to prevent injury, to be mindful of other participants in the Session and so the teacher can start the session on time. In line with our cancellation policy, you will not be refunded for Sessions you are unable to attend because you are late.

IF WE CANCEL YOUR BOOKING

In the event that we cancel a Session that you have booked, we will inform you by email. The class credit will be automatically refunded to your account.

PURCHASES

YOUR ACCOUNT WITH US

In order to book Sessions you must sign up for an account (Account) at www.arccollective.co (our Website). You must be at least 18 years of age to attend any Sessions at ARC Collective or accompanied by a parent or guardian if you are between 16 and 18 years.

PAYMENT TERMS

A) Drop ins, class passes, gift cards, workshops and courses. You can pay using your credit or debit card. Save in respect of your right to cancel (see section below), all class purchases are non-refundable. Your card details will be saved on your account automatically. You are welcome to request to have these removed each time you pay, but please note these are entirely encrypted so for your convenience you may wish to leave them intact. Those on rolling memberships cannot opt to remove their card details for obvious reasons.

B) Memberships. You can pay using your credit or debit card via www.arccollective.co. Your first month’s fee payment will be processed on the date you sign up. Your subsequent months’ membership fee payments will then be processed via your original payment method on the same day in each month that corresponds to the day of the month on which you signed up for your membership (or the nearest equivalent day in shorter months (where relevant)).

If payment is unsuccessful on the payment date, we will email you to notify you of the unsuccessful payment. We will attempt to make payment for 2 consecutive days. If after 48 hours payment has still not been made, then your membership will be suspended until payment has been made.

PROMOTIONAL OFFERS

From time to time we may run various promotions, prize draws and other offers (each a “Promotion”). We may implement separate terms and conditions in respect of any such Promotion, and will advise you accordingly where this is the case. However, notwithstanding this:

A) we reserve the right to end any promotion without warning at any time;

B) we also reserve the right to withdraw your right to any Promotion if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of the Promotion. Misuse includes, but is not limited to, the creation of multiple customer accounts and self-referral;

C) additionally, we reserve the right to not fulfil any future Sessions bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion; and

D) any prizes offered by us in connection with a Promotion must be claimed within 21 days of the announcement of the winners. We have 45 days to issue any such prize. We reserve the right to substitute any prize or promotion for the equivalent value in Sessions.

DISCOUNT CODES

From time to time we may make discount codes available to you, and your use of any such discount codes shall be subject to additional terms and conditions, which we will make you aware of at the time of use. Discount codes may only apply to certain Sessions and we will set this out in our applicable promotional communications. In the event that Sessions booked using a discount code are cancelled, the relevant Session will be cancelled in accordance with the terms above. In addition:

A) we reserve the right to end or withdraw any Discount Code without warning at any time;

B) we also reserve the right to withdraw your right to use any Discount Code if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of the Discount Code; and

C) additionally, we reserve the right to not fulfil any future Sessions bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Discount Code.

FOOD BANK USE

When accessing the food bank services, you are expected to treat all staff, volunteers, and other users with respect and courtesy. Any abusive, aggressive, or inappropriate behaviour will not be tolerated and may result in the suspension or permanent removal of access to the food bank services. Additionally, it is important to maintain the cleanliness and orderliness of the space, leaving the area in the same condition as you found it.

ATTENDING GARDENING SESSIONS

If you are attending gardening sessions, you agree to follow all safety instructions given by the instructors or staff. You are responsible for ensuring that any bending, standing, or movement involved in gardening is suitable for your body and current health condition. If any part of the gardening activity causes discomfort or poses a risk to your health, it is your responsibility to inform the instructor and adjust your participation accordingly.
We also expect you to treat our staff and gardening coordinators with respect. Any form of verbal or physical abuse toward staff will not be tolerated and may result in your immediate removal from the session and future sessions

USE OF PREMISES AND HIRING SPACE

When hiring our space, you agree to respect the property and facilities, ensuring no damage occurs to the premises or equipment. You will be responsible for any damages caused by you or your guests and may be charged for repairs or replacements. At the end of your hire, you must ensure the space is left clean, tidy, and in its original condition.

You agree to comply with any additional rules or instructions provided for the use of the premises, and access may be refused if these are not adhered to.

We reserve the right to refuse access to any client or group if their behaviour is deemed inappropriate, aggressive, rude, threatening, or damaging to the premises, staff, or other clients.


HOW WE CAN CONTACT EACH OTHER

By you: Any written notice, enquiry or feedback should be provided via email to hello@arccollective.co. You may change or cancel a Session online, or through the App or via email or a hire or your place in the food bank or garden session

By us: We may contact you using any of the contact details you provide to us when you sign up, which may include via telephone or text message. Our Privacy Notice sets out how we may process your personal data, which includes the contact details you provide to us.

You will be automatically signed up to our newsletter and other communications. If you wish to unsubscribe you can do so from your account. Please note, doing so means we will not be able to inform you of cancellations, changes to the schedule or any other information. We take no responsibility for clients who opt to unsubscribe if they are not aware of changes relevant to their visit.

COMPLAINTS

We always welcome feedback from our clients and, whilst we always use all reasonable endeavours to ensure that your experience as a client of ours is a positive one, We nevertheless want to hear from you if You have any cause for complaint. If you have any complaint about our Services or any other complaint about your teacher, member of staff or our venue please raise the matter with the teacher or other staff member at our premises, or by emailing hello@arccollective.co or the relevant project lead

FORCE MAJEURE

We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms if the delay was due to any cause beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. system failures, viruses, pandemic, epidemic, civil emergency or other widespread illness, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.

In the event that our studio is closed for a period of 7 days or more due to any cause beyond our reasonable control, we will grant you a membership freeze until our studio has reopened. Under these circumstances, the expiry date for your balance will be reset from the date that the studio reopens.

WAIVER

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. 

SEVERABILITY

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

ENTIRE AGREEMENT

These Terms together with our liability waiver and any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you.

THIRD PARTY RIGHTS

These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.
